DMCA Policy

XoniCerti respects the intellectual property rights of others and expects its users to do the same. Our study content (exam questions, explanations, study sheets) is prepared independently by our team; however, the Service allows users to post content to the forum and in comments, which could potentially infringe a third party's rights.
This policy describes the notice-and-takedown procedure, inspired by the Digital Millennium Copyright Act (DMCA), that allows rights holders anywhere in the world to report content they believe infringes their copyright.
1. How to report a copyright infringement
If you have a good-faith belief that content hosted on the Service reproduces a copyrighted work without authorization, you may send us a written notice at info@xonicerti.com.
To be processed, your notice must include the following:
- your physical or electronic signature as the copyright owner, or the person authorized to act on their behalf;
- a precise identification of the copyrighted work claimed to have been infringed;
- a precise identification of the disputed content on the Service, with its URL or enough information for us to locate it;
- your contact details: name, mailing address, phone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.
2. Our response procedure
Upon receiving a complete and compliant notice, we review it within a reasonable time and, if it is well founded, we remove or disable access to the disputed content. We then inform the user who posted the content of the removal and the reasons for it.
We reserve the right to reject any notice that is clearly incomplete, abusive, or unfounded.
3. Counter-notice
If you believe content belonging to you was removed by mistake or misidentified as infringing, you may send us a counter-notice at info@xonicerti.com, including your identification, identification of the removed content and its location before removal, a good-faith statement that the removal resulted from a mistake or misidentification, your consent to the jurisdiction of the applicable courts, and your signature.
Upon receiving a valid counter-notice, we may restore the content in question unless the rights holder initiates legal action within a reasonable time.
4. Repeat infringers
In accordance with our repeat-infringer policy, we reserve the right to suspend or terminate, in appropriate circumstances, the account of any user subject to repeated, well-founded copyright infringement notices.
