Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of the XoniCerti platform, available at xonicerti.com and its related applications (the "Service"), published and operated from Cameroon (the "Operator", "we").

By creating an account, accessing the Service, or using it in any way, you (the "User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

1. Description of the Service

XoniCerti provides IT certification preparation resources: practice exam questions, timed mock exams, exam simulators, study sheets, a community forum, and progress-tracking tools, covering certifications issued by vendors such as AWS, Cisco, CompTIA, Microsoft, or Google Cloud.

XoniCerti is an independent test-preparation service. We are not affiliated with, sponsored by, or endorsed by any of the certification vendors referenced on the Service, and all related names, logos, and trademarks remain the exclusive property of their respective owners. They are mentioned solely to identify which exams our preparation content covers.

2. User accounts

Access to certain features of the Service requires creating an account. You agree to provide accurate, current, and complete information when registering, and to keep it up to date.

You are solely responsible for keeping your login credentials confidential and for all activity carried out under your account. You must notify us without delay at info@xonicerti.com of any unauthorized use of your account.

The Service is reserved for individuals at least 16 years old, or the minimum age required in your jurisdiction to consent on your own to the processing of personal data. An account may only be created and used by a single individual; sharing or reselling accounts is prohibited.

3. Subscriptions, purchases and payment

The Service offers limited free access as well as paid plans, in the form of recurring subscriptions or one-time purchases granting access to one or more exams. Prices, currencies, and terms for each plan are shown before you confirm your order.

Card payments are processed by our payment provider, Stripe. XoniCerti does not collect or store your full payment card details. For certain business or institutional accounts, other payment methods (bank transfer, invoicing, manual settlement) may be offered by prior agreement.

Subscriptions renew automatically at the chosen interval unless cancelled by you before the renewal date, either from your "Subscription" account area or by simply contacting info@xonicerti.com.

4. Refund policy

Given the digital nature of the Service, any subscription or exam-access purchase is final once access to the corresponding content has been unlocked on your account. No refund will be granted once such access is activated, except where mandatory law applicable in your jurisdiction provides otherwise, or in the event of a proven billing error on our part.

In case of duplicate charges, a technical payment error, or any other billing anomaly, contact us at info@xonicerti.com and we will review your request on a case-by-case basis.

5. Intellectual property

All content on the Service — exam questions, explanations, answer keys, study sheets, text, layout, logos, the XoniCerti brand, and graphic elements — is protected by copyright and other intellectual property rights, and remains the exclusive property of XoniCerti or its licensors.

Subject to your compliance with these Terms and payment of any amounts due, you are granted a personal, non-exclusive, non-transferable, and revocable licence to access and use the content strictly for your own individual exam preparation.

Without our prior written permission, you may not, in particular:

  • copy, reproduce, extract, systematically screenshot, republish, or distribute all or part of the Service's content;
  • use scripts, bots, automated scraping tools, or any other technical means to collect content from the Service;
  • resell, sublicense, or make available to third parties access to your account or to the Service's content;
  • use the content to train an artificial intelligence model or build a competing database.

6. User-generated content

The Service allows you to post to the forum, comment on exam questions, and save bookmarks ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, royalty-free, non-exclusive licence to host, display, and moderate it as part of operating the Service.

You warrant that your User Content does not infringe any third-party rights (intellectual property, privacy, defamation) and does not contain unlawful, abusive, discriminatory, or fraudulent statements, nor any protected exam answers obtained from an unauthorized source.

We reserve the right, without obligation or notice, to moderate, edit, or remove any User Content that breaches these Terms, and to suspend the account of its author.

7. Acceptable use

By using the Service, you agree not to:

  • circumvent, disable, or attempt to circumvent the Service's technical security, access-limitation, or payment measures;
  • cheat, automate, or manipulate the results of practice tests and progress-tracking tools;
  • impersonate a third party or provide false information when registering;
  • introduce any virus or malicious code into the Service, or attempt to gain unauthorized access to our systems or those of other users;
  • use the Service for unlawful purposes or purposes contrary to its intended use as a certification preparation tool.

8. Third-party services and links

The Service may contain links to third-party sites (social networks, payment providers, certification vendor sites) provided for convenience. We do not control these third-party sites and disclaim any responsibility for their content, practices, or terms of use, which are matters directly between you and those third parties.

9. No guarantee of exam success

Our practice tests and resources are training tools intended to reinforce your knowledge; they are in no way a guarantee that you will pass an official certification exam, the format, content, and grading criteria of which remain the exclusive responsibility of the relevant certifying body.

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, as to its accuracy, completeness, or fitness for a particular purpose, to the extent permitted by applicable law.

10. Limitation of liability

To the extent permitted by applicable law, XoniCerti shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including loss of data, revenue, or a chance of passing an exam.

In all cases, our total liability to you, on any basis, is limited to the amount actually paid by you to XoniCerti during the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend and indemnify XoniCerti against any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your User Content, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, in case of a breach of these Terms, suspected fraud, or conduct harmful to the Service or other users. You may stop using the Service and request that your account be closed at any time from your "Settings" area or by contacting info@xonicerti.com.

13. Governing law and jurisdiction

These Terms are governed by the laws of Cameroon. Any dispute regarding their validity, interpretation, or performance that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Cameroon.

14. Changes to these Terms

We may amend these Terms at any time to reflect changes to the Service or legal requirements. Any material change will be notified to you by email or through the Service and will take effect on its publication date. Continued use of the Service after notice constitutes acceptance of the amended Terms.

15. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and XoniCerti regarding use of the Service.
